1. Agreement to Terms

By accessing our website or using Celestia's property rental services, you agree to be bound by these Terms and Conditions. If you disagree with any part of these terms, you may not access our services.

These terms constitute a legally binding agreement between you and Celestia. You must be at least 18 years old to use our services and make property reservations.

2. Definitions

For purposes of these Terms:

• "Service" refers to the property rental and booking services provided by Celestia
• "User," "You," and "Your" refer to the individual accessing or using the Service
• "We," "Us," and "Our" refer to Celestia
• "Property" refers to any residential accommodation offered through our Service
• "Booking" refers to a confirmed reservation for a Property

3. Service Description

Celestia provides access to residential properties in Thailand designed to support astronomical observation and evening sky appreciation. Our services include property booking facilitation, guest support, and coordination of property access.

We strive to maintain accurate property descriptions and availability information. However:

• Property availability is subject to change without notice
• Property features may vary from descriptions due to maintenance or improvements
• Weather conditions affecting sky visibility are beyond our control
• Equipment specifications may be updated or replaced with equivalent items

4. Booking and Reservations

4.1 Booking Process

To make a booking:

1. Submit an inquiry through our contact form or email
2. Receive property availability confirmation and pricing
3. Provide required information including identification and contact details
4. Submit payment according to our payment terms
5. Receive booking confirmation with property access details

4.2 Booking Confirmation

A booking is confirmed only when you receive written confirmation from us via email. Submission of an inquiry does not guarantee property availability or constitute a confirmed booking.

4.3 Minimum Stay Requirements

Properties have minimum stay requirements:

• Rooftop Access Residences: 1 night minimum
• Observatory Villas: 2 nights minimum
• Dark Sky Estate Reserves: 3 nights minimum

5. Payment Terms

Payment requirements:

• All prices are quoted in Thai Baht (฿) unless otherwise specified
• A deposit of 50% is required to confirm booking
• Remaining balance due 30 days before arrival
• Payment accepted via bank transfer or approved payment processors
• Prices include applicable taxes unless otherwise noted

You are responsible for any currency conversion fees or international transaction charges imposed by your financial institution.

6. Cancellation Policy

6.1 Guest Cancellation

Cancellation terms:

• More than 60 days before arrival: Full refund minus 10% processing fee
• 30-60 days before arrival: 50% refund
• Less than 30 days before arrival: No refund
• No-shows result in forfeiture of all payments

6.2 Our Right to Cancel

We reserve the right to cancel bookings due to property unavailability, safety concerns, or violation of these terms. In such cases, you will receive a full refund of all payments made.

7. Guest Responsibilities

As a guest, you agree to:

• Provide accurate information during the booking process
• Treat the property and equipment with reasonable care
• Follow all property rules and local regulations
• Not exceed the maximum occupancy stated for the property
• Use astronomical equipment according to provided instructions
• Report any damage or equipment malfunction promptly
• Maintain reasonable noise levels and respect neighboring properties
• Not engage in illegal activities on the premises

8. Property Access and Check-in

Property access procedures:

• Check-in time is typically 3:00 PM local time
• Check-out time is typically 11:00 AM local time
• Early check-in or late check-out may be available upon request
• Access instructions will be provided prior to arrival
• Valid identification must be presented upon arrival

9. Equipment Use and Safety

When using astronomical equipment and property facilities:

• Basic equipment instruction will be provided
• Equipment must be used as intended and according to guidelines
• Never look directly at the sun through any optical equipment
• Exercise caution when using rooftop or elevated observation areas
• Report any safety concerns immediately
• You are responsible for any damage caused by misuse of equipment

10. Limitation of Liability

To the maximum extent permitted by law:

• We are not liable for weather conditions affecting sky visibility
• We are not responsible for personal injury resulting from guest negligence
• Our liability for property-related issues is limited to the booking value
• We are not liable for indirect, consequential, or punitive damages
• Force majeure events absolve us of contractual obligations

Nothing in these terms limits our liability for fraud, death, or personal injury caused by our negligence.

11. Intellectual Property

All content on our website, including text, graphics, logos, images, and software, is our property or that of our licensors and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.

12. Privacy

Your use of our services is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information.

13. Dispute Resolution

Any disputes arising from these terms or use of our services shall be governed by the laws of Thailand. We encourage informal resolution of disputes through direct communication. If informal resolution fails, disputes shall be subject to the exclusive jurisdiction of the courts of Bangkok, Thailand.

14. Modifications to Terms

We reserve the right to modify these Terms and Conditions at any time. Changes will be effective when posted on our website with an updated effective date. Your continued use of our services after changes constitutes acceptance of the modified terms. We recommend reviewing these terms periodically.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
